BRUCE TOWNSHIP PLANNING COMMISSION

Meeting called to order: 7:03 p.m.

Pledge of Allegiance

Approval of Agenda: Item #9 Review of Pit Reclamation Plan-Montgomery Aggregate Products removed from agenda as information/application not received. Agenda accepted with change.

Approval of minutes: Motion by B. Osborne, 2nd by L. Little to approve the minutes of 6 June 2006 meeting as read. Unanimous approval.

Public comments: None

Zoning Administrator’s report: There were 7 new application’s this past month bringing the 2006 total to 25 permits which is down from last year. The number of stick built homes being constructed this

year has increased while permits for modular homes has decreased (5 modular-1 stick built 2005 and 7 stick built and 1 modular to date 2006).

Chairperson comments: The Nuisance Abatement Ordinance is being updated to incorporate changes suggested in sample ordinance on MTA website.

2). There was a circuit court hearing on 29 June 2006 concerning the Montgomery gravel pit issue on 15 mile road. Chairperson MacDonald, Supervisor Gallagher and Zoning Administrator Schmidt were in attendance. Judge ruled the Township had compiled with their part of the stipulations and Montgomery would need to comply with the requirements as previously agreed. A reclamation plan was to be submitted to the Planning Commission in advance of this meeting by Montgomery Aggregate Products. No plan was received so the item was deleted from the meeting agenda.

3). Burton Excavating has asked for a Special Land Use for a gravel pit on 15 Mile Road near the county pit. Paper work has not been submitted by the date of this meeting.

Commissioner comments: C. Person inquired about the procedure for dating amendments and other changes in the Township Ordinances. Chairperson indicated proper notations were made regarding amendment approval dates.

L. Little asked about enforcement procedures concerning RV camping trailers used for extended camping

located on property especially near the river. Many apparently have no sanitary system and pose a potential problem to health and surrounding environment. Zoning Administrator Schmidt will look into the situation if he is given location of set up.

No other commissioners had comments.

Public Hearing-Special Land Use- Wrecker Service on 9 Mile Road: Chairperson MacDonald and J. Fischer

spoke with Jeff Moran at the proposed location behind his residence on 9 Mile Road. Zoning

Administrator M. Schmidt also had conversation with J. Moran who was excused from attending this meeting. J. Moran would like to locate a fenced storage yard behind his residence for temporary storage of vehicles involved in the business. There would be no mechanical work involved.

Public Hearing opened at 7:40. One resident had a concern about the effect the damaged vehicles would have on leakage into the ground water and the wells in the area. Motion made by B. Osborne, 2nd by C. Marsh to close the hearing. Hearing closed at 7:48p.m.

A lengthy discussion followed among the commissioners with environmental contamination a topic. Another concern was how "temporary" the temporary vehicle storage would be. There was concern expressed that the proposed vehicle storage would affect land values in the immediate area. A consensus was reached that the Planning Commission needed more information before making a decision to grant a Special Land Use permit. Action was postponed until applicant can be present at meeting. Commissioners are urged to go to the site and J. Moran will be asked to attend the next meeting.

A proposed Zoning Ordinance Amendment No. 7 was presented by the Chairperson. Most of the changes involve changes in language to comply with the new State Laws. These changes will be presented to the Township Board and will require a Public Hearing at the August Planning Commission meeting..

The final review of the draft Master Plan was completed with a few comments from the commissioners. No changes were made and the plan will be presented to the Township Board for approval of circulation for comment. It will then be presented at a Public Hearing after any comments are considered.

Commissioners were asked to prepare a suggested map of potential zoning districts in the area. Several members had prepared such a document and a very short discussion followed. Chairperson concluded the topic best be continued at the next meeting.
